Kingston Bay Travel Terms and Conditions

Consumer Agreement


1. Introduction


These Terms and Conditions (“Agreement”) define the relationship between you (“you,” “your,” or “Client”) and Kingston Bay Travel, LLC (“Kingston Bay Travel,” “we,” “us,” or “our”) when you purchase or use travel-related services through us.  By accessing our website (https://www.kingstonbaytravel.com), requesting information, or making a booking, you agree to be bound by this Agreement and any applicable Supplier terms.


2. Role as Booking Agent


Kingston Bay Travel acts solely as an independent booking agent for third-party providers (“Suppliers”), including but not limited to airlines, hotels, tour operators, cruise lines, and transportation providers.

  • We do not own, operate, or control these services.
  • Your booking creates a separate contract between you and the Supplier.
  • Each Supplier has its own terms, conditions, and policies, which you agree to follow.
  • Supplier terms supersede ours where applicable.


We are not responsible for:

  • Supplier actions, errors, omissions, or failures
  • Service interruptions, cancellations, or overbookings
  • Denial of service by Suppliers
  • Changes made by Suppliers
  • Personal injury, property damage, or loss


Special needs or disabilities must be disclosed at booking.  We will attempt reasonable accommodations but cannot guarantee them.


3. Pricing, Deposits and Payments


  • A deposit and completed client profile are required to secure reservations.
  • Accepted payment methods: credit card, debit card, check, or cash (cards preferred).
  • A $50 fee applies to returned checks.
  • Final payment deadlines are listed on your invoice.
  • Final payment deadlines are strictly enforced.
  • Failure to pay may result in cancellation without refund.


Price Adjustments


Prices are subject to change due to:

  • Availability
  • Fuel surcharges
  • Taxes or government fees 
  • Currency fluctuations
  • Supplier imposed increases


You are responsible for any increases.  Prices are not guaranteed until paid in full.


4. Cancellation & Refund Policy


All payments are non-refundable unless explicitly stated otherwise in writing.

  • Cancellation penalties are determined by Suppliers
  • No refunds for:
    • Missed flights
    • Late arrivals
    • No-shows
    • Denied boarding


No exceptions for:

  • Illness or injury
  • Weather events
  • Pandemics
  • Government restrictions
  • Personal circumstances


Travel insurance is the only recommended protection


5. Chargeback & Payment Disputes


By submitting payment, you agree:

  • Not to initiate chargebacks or payment disputes without first contacting Kingston Bay Travel
  • Chargebacks made in violation of this Agreement are considered fraudulent disputes


If a chargeback occurs:

  • You agree to reimburse Kingston Bay Travel for:
    • The disputed amount
    • Administrative fees
    • Legal fees and collection costs


We reserve the right to:

  • Provide this Agreement as evidence to financial institutions
  • Pursue legal remedies


6. Communication and Electronic Consent


By booking or submitting your contact information, you consent to receive communications via:

  • Email
  • Phone
  • SMS/text messaging


Message/data rates may apply.
You may opt out of SMS at any time by replying “STOP.”

Consent to receive messages is not required to make a purchase


Electronic Signature Agreement


You agree that:

  • Electronic actions (clicking, payment, or booking) constitute a legally binding signature
  • This Agreement is enforceable under applicable electronic transaction laws


5. Group Bookings (If Applicable)


Financial Responsibility


The group leader:

  • Assumes full financial responsibility for the entire booking
  • Is liable for unpaid balances
  • In some cases, individual payments are credited toward the total balance


Changes & Cancellations

  • Must be submitted in writing
  • Subject to Supplier penalties and availability 


No exceptions to cancellation penalties, including:

  • Illness
  • Travel restrictions
  • Fear of travel
  • Pandemic-related disruptions


Full group cancellations: 

  • Trigger penalties based on total room block  

“No-shows” are treated as cancellations and subject to full penalties.


6. Agency-Planned Travel (If Applicable)


  • Prices and availability are subject to change until confirmed
  • Itineraries are subject to change
  • Comparable substitutions may be made
  • Suppliers control all logistics (flights, rooms, schedules)


Kingston Bay Travel is not responsible for:

  • Airline schedule changes
  • Seating assignments
  • Hotel room assignments


Baggage fees and optional services are not included unless stated.

Failure to make payments may result in cancellation without refund.


7. Travel Changes and Cancellations


  • Changes are subject to Supplier rules and availability.
  • Name changes are often treated as cancellations.
  • Partial cancellations may increase costs for remaining travelers.


If you cancel:

  • Refunds are subject to Supplier policies
  • Travel insurance may provide reimbursement (if applicable)


8. Travel Documents and Requirements


You are responsible for:

  • Verifying accuracy of travel documents
  • Obtaining passports, visas, and entry permits
  • Meeting health and vaccination requirements


Failure to comply may result in denied travel without refund.


9. Travel Insurance


Travel insurance is strongly recommended and may be required for some trips.

Kingston Bay Travel:

  • Is not an insurer
  • Does not guarantee coverage


All claims must be handled directly with the insurance provider.


10. Risks and Travel Advisories


Travel involves inherent risks.  Kingston Bay Travel does not guarantee safety at any destination.

You are responsible for reviewing official travel advisories, including those from:

  • U.S. Department of State


11. Airline and Transportation Policies


  • Flight schedules are controlled by airlines and may change
  • Missed flights or “no-shows” may result in full itinerary cancellation
  • You must reconfirm flights when required


12. Hazardous Materials and Safety Compliance


You agree to comply with all transportation safety regulations, including restrictions on hazardous materials.

Violations may result in fines or criminal penalties.


13. Complaint & Dispute Resolution


You must:

  1. Notify the Supplier immediately
  2. Contact Kingston Bay Travel promptly


Failure to do so may limit your ability to seek resolution.


14. Indemnification


You agree to indemnify and hold harmless Kingston Bay Travel and its partners from any claims, damages, or expenses arising from:

  • Your actions or negligence 
  • Your breach of this Agreement
  • Violations of law


15. Force Majeure


Kingston Bay Travel is not liable for failure or delay due to events beyond our control, including:

  • Natural disasters
  • Pandemics
  • Government actions
  • Labor disruptions


In such cases:

  • Refunds are not guaranteed 
  • Suppliers may issue credits or vouchers instead


16. Limitation of Liability


To the fullest extent permitted by law:

  • Kingston Bay Travel is not liable for indirect, incidental, or consequential damages
  • Maximum liability is limited to the amount paid to Kingston Bay Travel


17. Governing Law & Venue


This Agreement is governed by the laws of the State of South Carolina.

  • Claims must be filed within 7 business days of trip completion
  • Legal disputes must be filed in designated South Carolina courts


18. Modifications


We may update this Agreement at any time.  Continued use of our services constitutes acceptance of changes.


19. Entire Agreement


This Agreement:

  • Represents the entire understanding between parties
  • Supersedes all prior agreements


20. Acceptance of Terms


By booking travel or submitting payment, you confirm that:

  • You have read and understood this Agreement
  • You agree to all terms on behalf of yourself and your party
